Terms of Service

Important: WITYA is a profiling tool, not a financial adviser. Nothing on this platform constitutes investment advice. All investment decisions remain entirely your own responsibility.

1. Nature of the Service

WITYA ("the Platform", "we", "us") is an online investor profiling tool. The Platform presents users with a structured questionnaire and, based on their responses, generates a psychological and financial profile that describes general investment tendencies and behavioral patterns. The results produced by the Platform are purely informational and educational in nature. They are intended to help users develop self-awareness about their own attitudes towards risk, time horizon, and financial behaviour. They do not constitute, and must not be interpreted as, financial advice, investment recommendations, portfolio management services, or any form of regulated financial service.

2. No Investment Advice

The Platform does not provide investment advice of any kind. Nothing on this Platform — including but not limited to questionnaire results, investor profile descriptions, archetype classifications, or portfolio allocation illustrations — constitutes a personalised recommendation to buy, sell, hold, or otherwise deal in any financial instrument, security, fund, asset class, or investment product. Any reference to asset classes or portfolio structures within the Platform is strictly illustrative and is provided solely to contextualise the profile results. Such references do not represent advice to act upon. You should always seek independent, regulated financial advice from a qualified professional before making any investment decision.

3. No Regulated Activity

WITYA is not a registered investment adviser, broker-dealer, financial planner, financial analyst, or any other type of regulated financial service provider. The Platform does not hold any licence or authorisation to carry out regulated activities under any applicable financial services legislation. Use of the Platform does not create any advisory, fiduciary, or contractual relationship between you and WITYA in respect of investment matters.

4. Accuracy and Limitations of Results

The investor profile assigned to a user is generated algorithmically on the basis of answers provided at a single point in time. Profiles are approximations and inherently subject to the limitations of any self-assessment tool. They may not fully capture the complexity of a user's financial situation, goals, risk capacity, or personal circumstances. Results may change over time as personal circumstances evolve. The Platform does not represent that any profile is definitive, complete, or permanently applicable to any individual user.

5. Limitation of Liability

To the fullest extent permitted by applicable law, WITYA, its affiliates, directors, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary loss or damage arising out of or in connection with: (a) your use of, or inability to use, the Platform or its results; (b) any investment or financial decision made in reliance on, or influenced by, information obtained through the Platform; (c) any loss of capital, loss of profit, loss of data, or any other financial or economic loss, regardless of whether such loss was foreseeable or WITYA had been advised of the possibility of such loss. You acknowledge that all investment activities carry risk, including the risk of total loss of capital, and that you bear sole responsibility for any decisions you make.

6. User Responsibilities

By using the Platform you confirm that: (a) you are using the Platform solely for personal, non-commercial, informational purposes; (b) you will not rely on Platform outputs as the primary or sole basis for any financial decision; (c) you are responsible for verifying the accuracy of information you provide during the questionnaire; (d) you will seek qualified professional advice before undertaking any investment activity.

7. Data and Privacy

Your use of the Platform is also governed by our Privacy Policy. By accepting these Terms you acknowledge that you have read and understood how we collect, use, and protect your personal data. We do not sell your personal data to third parties. Your email address is never stored in plain text. It is hashed using a one-way cryptographic function before being persisted to our systems, so that even in the event of a data breach your email address cannot be recovered from our storage.

8. Intellectual Property

All content on the Platform, including but not limited to the questionnaire, methodology, text, graphics, and software, is the property of WITYA and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any Platform content without prior written permission.

9. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with a revised effective date. Continued use of the Platform after any such changes constitutes your acceptance of the new Terms. If you do not agree to the revised Terms, you must stop using the Platform.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which WITYA operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction.
